Former FDNY Firefighter, Jake Gardener, Now Lawyer for our Case against the City gives an impromptu Summary of the Litigation that just happened in the courtroom. He held a Q n A in Madison Square Park across from the Appelate Division of the State Supreme Court where the Appeal was heard. Marianne Pizzitola stands to his right video-taping the proceedings.

On a cold day in March, 175 Retirees from all walks of life showed up at the Appelate Courthouse of the State Supreme Court on East 25th St. in NYC. They were there to show their support for the Appeal Proceedings against the City of NY. The case is entitled
BENTKOWSKI vs The City of NY
Jake Gardener, a former FDNY Firefighter (Ladder 43) now Lawyer represented us in the courtroom and did a terrific job!
Myself (Bill Schillinger) and Jimmy Hayhurst had front row seats in the courtroom along with 148 other retirees. It was a beautiful courtoom to watch the proceedings. "ALL RISE" and then 5 Judges walked in-WOW! This was like watching a streaming movie on NETFLIX. The head Judge, a female Judge read the order of the docket. Our place was no where near the top but this Judge made us First! We really impressed the 5 judges with our presence. There was 150 in the Courtroom, the others were downstairs watching it on Closed Circuit TV, so everyone got to see the litigation. The City went first and expressed their lies. The Judges kept asking the City Lawyer for some form of proof but he could not produce it. Our Lawyer, Jake Gardener then got up and spoke our case. It seemed to me and Jimmy that he was very thorough in expressing our views in the case against the Medicare Advantage. Outside the crowd in the park agreed. After Jake spoke in the Courtroom, we began to applaud but the Court Officers quelled us. The applause in the park made up for it.
Many questions were taken by Jake in the Park. I asked, "Well what if we win?" Jake replied that the city would appeal and drag it on but in the meantime we get to keep our "PROMISED HEALTHCARE".
THE DECISION CAME DOWN IN OUR FAVOR, NOW AWAITING THE CITY'S RESPONSE...(Update-The City has appealed; waiting for court's decision on whether they will hear the appeal)
